Fergus James values the privacy of our customers – we collect data to enhance the customer experience and security.  The privacy policy informs users what information is collected, why we need this information and how we use the information to enhance the user experience. 

Introduction

Fergus James are a luxury bespoke designer and manufacturer of fine jewellery. We are dedicated to utilizing policies, procedures and practices that protect and regard users privacy in compliance with the EU General Data Protection Regulation (“GDPR”) guidelines. Fergus James, owned by Diamond Rocks Trading DMCC, is registered in the DMCC Free zone Dubai, United Arab Emirates and for the purposes of the Data Protection Act 1998 and GDPR, the data controller is Fergus James.

At certain times, Fergus James gathers and uses information about users to enhance the website user experience, in order to make our site more user-friendly.  The Privacy Policy communicates what types of data we collect along with how it is used and stored in a safe, secure environment.  Fergus James gathers information from website users, or anyone who has had any contact with the organization including, but not limited to, walk-in customers, suppliers, affiliates, business contacts and employees.

The Fergus James privacy policy applies to all our website users, staff, business suppliers contacts and associates.  The Policy is drafted to ensure that:

  • The personal data rights of our customers, staff and business associates are recognized and protected
  • Personal Data is processed in compliance with GDPR
  • Fergus James are mindful of our responsibilities and requirements when processing Personal Data

Fergus James collect, use and store information of website users in order to fulfill contractual obligations as well as to improve and enhance the website users personal fine-jewellery buying experience.

Users provide Fergus James with formation through a variety of different mediums including, but not limited to:

  • Over email
  • Filling in forms or ticking boxes
  • Personal meetings in our showrooms

The information given to us includes, but is not limited to:

We will only receive information from the listed businesses if it is necessary.

Fergus James does not collect any unique categories of personal data – such as race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health and genetic, biometric data, or criminal convictions and offences.

If personal data is required and you fail to provide the necessary data when requested, we may not be able to start and perform the contract that we have attempted to enter with you. If we cannot proceed, we may have to cancel the service you have with Fergus James, but we will be sure to notify you if this is the case.

Fergus James will only use your personal data when the law permits us to. We will use your personal information:

  • Fraud prevention agencies

Many of our external third parties, including Salesforce and Google Analytics, are based outside the European Economic Area (“EEA”) so their processing of your personal data will involve a transfer of data outside the EEA to the USA, for example.

If this is necessary, we have procedures in place to ensure that this data receives the same process as we follow for the EEA. We will treat the information the same as we would for EAA companies under the stipulations of this Privacy Notice.

Fergus James has the taken appropriate security measures to prevent your personal data from being accidentally lost, used, altered or accessed in an unauthorised way.
